Description The bill seeks to make amendments to the Homeland Security Act of 2002 to offer authorizations for medical equipment to be transferred to the USA and across the nation in response to the Covid-19 public health emergency, or for other emergency purposes. Sponsored by Senior Senator for Wisconsin, Ron Johnson (R), on 2nd July 2020, the bill offers authorization to the Department of Homeland Security to make transfer to medically necessary equipment, such as personal protective equipment, to the Department of Health and Human Services in response to a public health emergency as declared. The bill indicates that the transfer of medically necessary equipment must be made on a reimbursable basis and at the request of the Department of Health and Human Services (GovTrack.us, 2020).

Legislative Intent The bill acknowledges that Covid-19 has placed an unprecedented stress on health care resources to include medical equipment. In fact, the nation is experiencing a critical supply shortage of medical equipment even as the need for these equipment, particularly personal protective equipment and ventilators, increases in response to the increasing number of persons diagnosed with Covid-19 and requiring care (Gondi et al., 2020). The national strategic reserve for medical equipment is small and far from sufficient to address the existing and projected gap. This has created a situation in which both patients and medical personnel are placed under great pressure with high infection rates. Estimates suggest that more medical equipment are needed. The situation has been worsened by the fact that Covid-19 is a global phenomenon so that countries that typically produce medical equipment have halted exports in order to meet their domestic demands thus making it difficult to for the USA to rely on imports in order to meet the demand (Ranney, Griffeth & Jha, 2020). The bill helps to address this concern by authorizing the Department of Homeland Security to act as an agent of the Department of Health and Human Services to acquire medical equipment to meet the shortage (Congress.Gov, 2020).
Proponents/ Opponents Proponents: Medical personnel and patients who deal with Covid-19 and require the equipment to ensure that health care is provided in a safe environment that prevents cross infection while allowing patients to recover.
Opponents: There is no discernible opposition for the bill as it is intended to address a national public health emergency. Besides that, there is an existing need for medical equipment and they are expected to be put into full use once acquired. The bill simply helps to shorten the supply chain thereby making the equipment more readily available.
Target Population The target population is the American public, medical personnel and patients. The American public are targeted by availing personal protective equipment that would help to keep them safe while enabling them to go through their daily activities. Availing masks enables Americans to engage in public activities with minimal risk of infection. The medical personnel are targeted by availing personal protective equipment that would keep them safe even as they provide medical care to Covid-19 patients. The absence of personal protective equipment places the medical personnel of contracting the virus when they provide health care to Covid-19 patients.
Status of the bill (Is it in hearings or committees?) The is currently before the Senate committee on Homeland Security and Governmental Affairs for consideration. The next step would entail the bill being presented to the Senate and House before being signed by the President. There is a recommendation that the bill be amended in the nature of a substitute favorably (Congress.Gov, 2020).
General Notes/Comments

 

 

The bill addresses an existing concern. Covid-19 has placed a strain on the available medical equipment to include the national reserves. At the current rate of use, the available medical equipment are unlikely to meet the existing demand with the situation expected to worsen unless new medical equipment can be acquired. The issue is worsened by the fact that Covid-19 is a global concern so that other countries are experiencing similar medical equipment shortages. The plan to leverage the resources of the Department of Homeland Security is the right decision since this shorten the supply chain for medical equipment and increase the availability of medical equipment across the nation.
